1. Agreement

These Terms of Service ("Terms") govern your access to and use of the OctaDeploy platform (octadeploy.com and app.octadeploy.com) operated by Octagon Solutions LLC, Florida, USA ("OctaDeploy", "we", "us"). By creating an account or using the service, you accept these Terms in full. If you do not agree, do not use OctaDeploy.

2. The Service

OctaDeploy is a cloud hosting platform (PaaS) that allows you to deploy web applications from Git repositories using Docker containers. The service includes automatic SSL certificate provisioning, custom domain management, environment variable storage, deployment logs, and billing management, as described at octadeploy.com.

3. Account Registration

You must provide accurate and complete information when creating an account. You are solely responsible for maintaining the security of your credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account, or have verifiable parental or guardian consent.

4. Acceptable Use

You agree not to use OctaDeploy to:

• Host content that is illegal under applicable law
• Distribute malware, conduct phishing attacks, or send unsolicited messages (spam)
• Attempt to gain unauthorised access to other systems, networks, or accounts
• Consume resources in a manner that materially degrades the service for other users
• Infringe intellectual property rights of third parties
• Circumvent billing, usage limits, or technical restrictions of the platform

We reserve the right to suspend accounts that violate this policy, with or without prior notice depending on severity.

5. Payment & Billing

Subscription plans are billed monthly or annually in advance. All payments are processed by Stripe, Inc. By providing payment details, you authorise recurring charges for your selected plan. Invoices are generated automatically and sent to your account email. Failure to pay within 7 days of the due date may result in service suspension. Refunds are not provided for partial unused billing periods, except where required by applicable mandatory consumer law in your country of residence.

6. Service Level

We target 99.9% monthly uptime for deployed applications. Planned maintenance windows are announced at least 24 hours in advance via email or status page. Service credits for downtime exceeding the SLA target may be requested in writing within 14 days of the incident.

7. Data Ownership

You retain full ownership of all application code, data, and content you deploy on OctaDeploy. We claim no intellectual property rights over your content. You grant us a limited licence to store, process, and transmit your content solely to provide the service.

8. Confidentiality

We treat your environment variables, source code, and application data as confidential. We will not access your application data except as necessary to provide the service or as required by law, and only with prior notice where possible.

9. Termination

You may terminate your account at any time from the account settings panel. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain unpaid for more than 14 days. Upon termination, your application data is retained for 30 days to allow migration, then permanently and irreversibly deleted.

10. Limitation of Liability

To the maximum extent permitted by applicable law, OctaDeploy's total liability for any claim arising from these Terms or the service shall not exceed the total fees paid by you in the three calendar months immediately preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data loss, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law provisions. EU and Swiss consumers retain the benefit of any mandatory consumer protection provisions applicable in their country of habitual residence that cannot be derogated by contract. Disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 60 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive relief in any court of competent jurisdiction.

12. Changes to Terms

We will notify you by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
